• INTRODUCTION

  Any order placed by private customers with Secretos del Agua at www.secretosdelagua.com is subject without limitation to these Terms and Conditions. Private customers are defined as private individuals who restrict the use of Secretos del Agua products to their own personal needs or those of their family and friends.

• ORDERS

  All available products are displayed on the corresponding page of www.secretosdelagua.com unless stated otherwise as out of stock.

• PRICE OF THE ITEMS

  The prices applicable to the products are those displayed at the time the order is placed, and all prices include taxes (VAT or similar). A breakdown of these taxes will be provided before the order is completed and confirmed. Please note that when you complete your order, the system will provide detailed information regarding the total taxable amount, applicable taxes and corresponding shipping costs.

  Taxes, duties and shipping costs may vary depending on the tax or physical area from which the order is placed or to which it must be shipped, therefore they may be modified or deducted after selecting the shipping area.

  Offers or discount vouchers may have an expiry date after which they will no longer be valid.

  The prices displayed on the platform may be reviewed and modified at any time, as they are subject to market changes.

• PAYMENT METHODS

  Purchases of products and services may be paid for by credit or debit card, and payment will be processed through a secure payment gateway such as Redsys.

  All your data will be encrypted and transmitted through a secure SSL (Security Socket Layers) server, ensuring that neither the owners of this Online Store nor any third parties will have access to your bank or credit card details.

  Once the information has been entered, the banking institution will validate your credit card and process the payment. At that moment, the order will become effective and will proceed to processing and shipping.

• SHIPPING AND DELIVERY

  Each of the products displayed on the website with its unit price corresponds to the total price, including taxes, and does not include shipping and customs costs.

  Any costs arising from shipping and customs duties shall be borne by the customer. The exact shipping costs applicable to the order will be communicated at all times before the order is accepted. The purchased products will be delivered to the individual or legal entity and at the address indicated, within the timeframe specified for each type of shipment.

  Shipments within Spain are delivered within an estimated period of 48 to 72 working hours from receipt of payment and subject to stock availability, through a specialist delivery company.

  For the purpose of calculating delivery times, Saturdays, Sundays and public holidays (both national and local) will not be considered working days.

  If a product is out of stock, delivery times may be delayed until the item is restocked. In such cases, Secretos del Agua declines all responsibility and will inform the customer of the estimated restocking and subsequent delivery timeframe.

  Orders will not be delivered to PO boxes, and we reserve the right to withhold shipments with incorrect addresses. In any case, our customer service department will contact you using the details provided regarding any incident or query that may arise during the processing of your order.

• AVAILABILITY

  Secretos del Agua will make every effort to satisfy all customer demand for its products.

  In the event that a product becomes unavailable after an order has been placed, the customer will be informed by email of the cancellation of the order.

• SHIPPING COSTS

  Currently, Secretos del Agua ships within Spain, including the mainland and the Balearic Islands, as well as to Germany and Portugal. At present, shipments are not available to the Canary Islands, Ceuta or Melilla.

  Portugal: €3

  Germany: €3

  For orders over €70, VAT included, shipping costs will not be charged.

  Orders collected from any Secretos del Agua partner salon will also incur no shipping costs. Returns for orders collected from Secretos del Agua partner salons will be processed in the same way as for all other orders placed through our website.

• REFUNDS AND RETURNS
  The customer may request the return of Products purchased through this website within fourteen (14) calendar days from the date of receipt of the Products, provided that the Products have not been unsealed upon delivery or collection.

  The return process includes the reimbursement of the amounts paid for the purchase of the Products listed on the website, as well as the arrangement of a courier service for the collection of the Products at no cost to the customer for return and transport services.

  Customers who do not fall under the category of consumers shall have the right to return Products purchased through the website within seven (7) days, provided that the Products have not been unsealed upon delivery and that they assume the transport costs for the return, except in the following cases:

  • The customer has received an incorrect order, where the purchased Products do not correspond to the Products received.

  • The Products received present manufacturing defects or have been received in poor condition as a result of the transport service.

  If, at the time of collection or delivery of the Products, the customer notices defects in the packaging, this must be stated in the collection or delivery document in order to report the incident.

  If a Secretos del Agua Salon carries out a personalised diagnosis for the customer and determines that the purchased Products are not suitable for their skin or hair type.

  In the above cases, a courier service will be made available to the customer for the collection of the Products at no cost for return and transport services.

  Process for returning Secretos del Agua Products

  To correctly exercise the right to return Products, the customer must contact Secretos del Agua by email at hola@secretosdelagua.com, indicating the order number, full name, invoice number of the original order and whether the return concerns all or part of the purchased Products. In the event of a partial return, the customer must specify the Products to be returned.

  Once the return has been communicated, the Secretos del Agua Customer Service Department will indicate whether the collection of the Products is applicable. If approved, the condition of the Products will be verified at the Secretos del Agua facilities once they have been collected.

  Furthermore, the Products must be in perfect condition, sealed and in their original packaging.

  Product exchange policy

  If the customer wishes to exchange purchased Products for different Products, they must request the return of the delivered Products and place a new order for the new Products they wish to purchase.

  Return of Products purchased through the website at Secretos del Agua Salons

  Secretos del Agua Salons are not authorised to accept the return of any Product purchased through this website. The return of Products purchased online must be made by sending an email to the Secretos del Agua Customer Service Department at hola@secretosdelagua.com and in accordance with the process established in the Secretos del Agua Product Return Process.

  Data protection in the Product return process

  Customer data will only be processed by the company owning the Secretos del Agua brand and its subsidiaries for the purpose of processing and shipping orders, and such data will not be disclosed or shared with third parties.

  In accordance with Regulation 2016/679 of the European Parliament and of the Council of 27 April 2016, as well as Organic Law 3/2018 of 5 December on the Protection of Personal Data and guarantee of digital rights, customers will have access to their personal data and may request its rectification or deletion. To exercise these rights, a request must be sent either by post to calle Binefar s/n, 22510, Binaced, Huesca, or by email to hola@secretosdelagua.com, indicating the right they wish to exercise.

  The liability assumed by the company owning the Secretos del Agua brand shall be limited to rectification under the terms set out above. The company shall not be liable for any incidental damages that may arise from the performance of the services. By way of example and without limitation, this category includes damages for loss of data, files, images, information, opportunities or profits, and moral damages.

  Likewise, the company shall not assume any responsibility for colour differences between the original image and the supplied product caused by poor quality of the original image file. Claims based on aesthetic preference shall not be considered defects in the goods.

  The guarantees and liabilities provided for in this section shall not apply where the defect is due to force majeure or to causes attributable to the customer. In all cases, the guarantee offered herein replaces any other guarantees.

• EXCHANGES

  Unfortunately, we are unable to offer product exchanges at this time. If you would like to exchange your item for a different product, please arrange a return for the unwanted item and place a new online order for the product you wish to purchase.

• GUARANTEE

  Guarantees and after sales services shall be governed by Royal Legislative Decree 1/2007 of 16 November, approving the revised text of the General Law for the Protection of Consumers and Users. In accordance with this regulation, the seller is obliged to deliver products to the consumer and user that are in conformity with the contract, being liable for any lack of conformity.

• AMENDMENT OF THE TERMS AND CONDITIONS

  Secretos del Agua reserves the right to amend these Terms and Conditions at any time by publishing a new version of the Terms and Conditions on its website at www.secretosdelagua.com. The Terms and Conditions applicable to any order are those published on www.secretosdelagua.com on the date the order is placed.

  The fact that Secretos del Agua does not exercise or delays the exercise of any right provided under these Terms and Conditions shall not constitute a waiver of that right or of any other rights. No partial exercise of any right under these Terms and Conditions shall prevent any subsequent exercise of that right or the exercise of any other right.

• LIABILITY, APPLICABLE LAW AND JURISDICTION

  Secretos del Agua shall not be held liable for the failure to perform any obligation under these Terms and Conditions in cases of force majeure or any circumstance beyond its reasonable control, including but not limited to fire, flood, acts of God, government regulations, strikes, epidemics, pandemics, riots or similar events, or shortages of supplies.

  These Terms and Conditions and all matters arising from or related to them shall be governed by the laws of Spain.

  For the resolution of any disputes or matters related to this website or the activities carried out on it, Spanish law shall apply, to which the parties expressly submit themselves. The Courts and Tribunals of the city of Madrid shall have jurisdiction over all conflicts arising from or related to its use.
